Seeking a Divorce

If the divorce goes to trial, representing a client is far more than just a court trial through which you can guide them. The successful attorneys at LaFortune & LaFortune have the judgment and experience to present the facts to a judge. This enables the judge to understand the facts with a perspective most favorable to our clients. From that understanding the attorney presents a powerful justification for the court to rule in favor of our client.

After divorce, there are situations in which divorcees find a need to return to court for a modification or change from their original divorce agreement. This action generally occurs to change custody for a child. As time went on one party might decide it would be more suitable for the child to live with them in a way that differs from the original agreement. Also, monetary changes that are significant can give rise to an action to modify child support or alimony.

These are very fact specific situations that require a meeting with the attorneys at LaFortune and LaFortune in considering whether or not to proceed with such an action against the former spouse, or how to defend an action by a former spouse.

Maybe that is why so many attorneys bring their own personal divorce problems to LaFortune & LaFortune.

Legal Separation

Occasionally, clients are not ready to divorce, legally terminating their marriage. These clients may opt to mediate issues. Please see our practice section on mediation.

Often, clients desire a legal "Time Off" away from each other to be sure the marriage is over before taking the divorce step. In these situations, a legal separation may be the right approach. A legal separation is what it sounds like. The parties can reach an agreement approved by the court or decision by a judge. Assets are not permanently divided, but arrangements of monetary support and visitation can be made. The couple is generally certain about the future course of their relationship after the separation. LaFortune & LaFortune will guide the client through the legal options and keeps the client informed of progress in the case. Separation agreements may also be reached through mediation.

Finding the Right Solution

Even without a trial, divorce and family law require a depth of understanding from both an emotional and financial perspective, and the ability work effectively with the opposing attorney and the court to present a strong case for the benefit of the client. It is well established that gaining a successful divorce recovery is heavily influenced when the attorney has credibility. It is critical for the attorney to articulate the cause of divorce from the client's perspective to the court, knowing when to be confrontational with the opposition and when not to be.
